The information contained in the Nikah Nama is used for marriage documentation. There are 25 columns in the Nikah Nama  (Nikah form) in Pakistan. It can be written in Urdu or English. Nikah Namas are used for recording Nikah’s details. A document that records details about Nikah and the parties involved in this contract, such as the witnesses’ names, addresses, amount of dowers, and the terms of this marriage contract.

Nikah Nama Can Be Categorized Into Three Types

As part of the first category of a Nikah Nama, both parties must provide factual information. The Nikah Khawan/Registrar needs to verify that the parties’ names and dates of birth match those on their ID cards or B forms. The Child Marriage Restraint Act imposes liability on the parties if the documentation is not checked and the marriage is found to be underage. Both addresses can be mentioned if the current address is different from the permanent address. 

 Following the determination of the bride’s marital status, she appoints an agent, and then her witnesses’ names and relationships must be carefully filled in. As part of the third category of columns in the Nikah nama, you can specify the mutual responsibilities and other aspects of your marriage. Writing conditions clearly and unambiguously is essential for enforcing them, without ambiguities that can cause problems.

In many parts of Pakistan, exchange marriages or ‘Watta Satta’ are common, where both parties agree to exchange a woman for another.

Various Aspects of a Nikah Nama can have a Legal Impact:

The Nikah Nama can also record the relinquishment of Dower. It is ultimately up to the woman to relinquish her dower. Dower can be relinquished or gifted according to law, but it is the male spouse who has to prove it. If a dispute occurs over the wife’s dower, the Court of Justice must verify that the individual relinquishing the dower acted as a free agent by substantiating the affidavit with evidence that it was not coerced.

Jewellery given by the groom to a bride belongs to the bride , while jewellery given by the bride to the groom, belongs to the groom. An injured wife may sue for compensation when her husband fails to fulfil a promise to give her a gift or undertaking recorded in  Nikah Nama (usually column 17)

 Nikah Nama Can Restrict Second Marriage:

It is mandatory for a man to get permission from  his first wife before he enters a second marriage in Pakistan, as well as get approval from an arbitration council. The Union Council of the applicant’s existing wife’s home must receive application for second marriage, regardless of whether the applicant’s existing wife resides in a different city at the time of the application submission.

Law regarding the marriage of an underage child:

Child Marriage Restraint Act (CMRA) amendments in 2015 did not fundamentally alter the law but rather strengthened it against certain violations. Child marriages are defined by the Child Marriage Restraint Act (CMRA) as marriages between parties under the legal age for marriage (18 years old for both genders). Although child marriages are punishable, they do not invalidate marriages. If the parties do not ratify the marriage or repudiate it, the spouses continue to live together. 

 

Males under the age of eighteen and females under the age of sixteen years are considered underage children.

Forced Marriages in Pakistan:

The Pakistan Penal Code (PPC) or any other law dealing with forced marriages punishes coercion, misrepresentation, or forced marriage without free consent.
